Terms Of Usage
- Lead purchasing company (referred as ‘Client’ here) is a Registered Company and falls under the complete regulation of TRAI (https://www.trai.gov.in/) and Loans process related regulations, and would follow all the terms described as per TRAI Guidelines (https://www.trai.gov.in/).
- Leads provided by YoGi’s Team purely interest shown by the Loan Seeker (referred to as customer here) for that Personal Loan Product on the campaign pushed, It is still highly recommended to take consent before proceeding.
- By using our services Client agrees to follow all marketing and Privacy policy-related regulation guidelines by Govt of India.
- Also kindly note as per our disclaimer, it remains the complete responsibility of the Client to manage DND and client consent before starting the process.
- Client and Customer are solely responsible for any dispute/issues/claim/settlement or defaulting of EMI or Full Loan Amount. YoGi Direct Marketing/Paresh Pavani/Virendra Pavani or any team member’s role is only Lead generation and once Customer’s successful Lead is delivered by Email, it remains Bank/Bank DSA/NBFC to further verify details and profiles of Loan Applicant and our team plays no role beyond this point. Hence We do not take any responsibility for such disputes/issues/penalty clauses or any settlement that arises between the Loan Applicant and Bank/Bank DSA/NBFC/Lending Partner as further processes are purely carried out post-complete profile and background checks followed by legal write-ups.
- Also as per the discussion, Client or its team member doesn’t charge any upfront payment to the customer and the same is our (YoGi Direct Marketing) understanding with the customer at the time the lead gets generated. Hence YoGi Direct Marketing is making it more clear to be part of our email conversation as well, so we all can be on the same page.
- Terms of usage are applicable to Client using our Lead services in the current order, Previous orders already delivered if any, and also to any future replacements, additional and recurring orders as default terms of usage, and Client is solely responsible for using our services as their moral and social responsibility to follow all the regulations ethically towards Indian Laws and privacy policy. Any breach would be treated as negligence towards the regulations and privacy policy and the client would be solely responsible for such act, which attracts immediate discontinuation of services without prior notice.
- It is also the complete responsibility of the NBFC/Bank/Bank DSA/Lending Partner to whom the application is submitted to verify loan applicants’ eligibility, profile, history etc. before lending or financing for the purposes and YoGi Direct Marketing /Paresh Pavani/Prayosha Easy Loan team’s role is only till connecting Loan Applicant to NBFC/Bank/Bank DSA/Lending Partner, Post which it remains complete responsibility of NBFC/Bank/Bank DSA/Lending Partner to approve/disapprove loan application till repayment of Loan amount and our team plays no role in the transaction once both the parties are connected.
- Client agrees to all the Terms of usage mentioned here as End user only, and is also not allowed to resell or forward Leads to any third party/parties in the form of gift or commercial values. In such cases the client is solely responsible for all the consequences including discontinuation of service without any prior notice and without refund.
- Our Services are strictly served only to registered clients following all the complete regulations by Govt of India and any services taken by client by providing wrongful/misleading information would result in immediate discontinuation without any refund and client would be solely responsible for such unlawful act.
- YoGi Direct Marketing/Paresh Pavani/Virendra Pavani do not provide any database or Marketing List support to their clients or third party. Our Lead generation services are inbound and consent based. However we strongly recommend our clients strictly follow consent and DND status before using the same to ensure there is no change in the status of both of these parameters while executing the actual use of Leads generated. By using our services Client/Service user agrees to take complete responsibilities in case consent and DND norms and social media norms are not followed by them while using it and YoGi Direct Marketing/Paresh Pavani/Virendra Pavani do not take any responsibility for such disputes/issues/penalty clauses or any settlement that arises between Client and customer/Interested Prospect.
Note: Our Services include Business Development Platforms for clients already having opt-in/subscribed customers for their products and services. We do not sell, promote or encourage any List support/Database. SMS List support for Promotional SMS services has been stopped well in advance before July 2023. Clients with their existing lists of opt-in/subscribers are requested to contact for sending updates/notifications etc. which should be as per DND regulations only. Clients calling for List Support would be rejected directly.
